4. Customer Cancellation (Cancellation, No-Show)
4.1 A customer may only cancel a contract with the hotel if a right of cancellation has been expressly agreed upon in the contract, if another statutory right of cancellation exists, or if the hotel expressly agrees to the cancellation.
An agreement regarding a right of cancellation, as well as any consent to a cancellation, must be in writing.
4.2 If a deadline for free cancellation has been agreed upon between the hotel and the customer, the customer may cancel the contract up to that deadline without incurring any payment or damage claims from the hotel. The customer’s right of cancellation expires if they do not exercise their right to cancel with the hotel by the agreed deadline.
4.3 If the customer cancels between the booking date and the cancellation deadline, the hotel is entitled to charge the customer a processing fee of 10% of the booked services.
If the customer cancels at a time less than
a) for up to 5 rooms, up to 14 days before the booked arrival date
b) for up to 20 rooms, up to 28 days before the booked arrival date
c) for 20 or more rooms, up to 42 days before the booked arrival date
the hotel is entitled to charge the customer the cancellation fees specified in sections 4.5, 4.6, 4.7, and 4.8.
4.4 If no right of withdrawal has been agreed upon or has already expired, and the hotel does not agree to a cancellation of the contract, the hotel retains its claim to the agreed remuneration despite the guest’s failure to use the services.
The hotel must credit any income from renting the rooms to other guests as well as any expenses saved.
If the rooms are not rented to other guests, the hotel may apply a flat-rate deduction for the expenses saved in accordance with sections 4.5, 4.6, 4.7, and 4.8. The customer is free to prove that the aforementioned claim did not arise or did not arise in the amount claimed. The hotel is free to prove that a higher claim arose.
4.5 In this case, the customer is obligated to pay at least 90% of the contractually agreed price for overnight stays with or without breakfast, as well as for package deals including third-party services, 70% for half-board arrangements, and 60% for full-board arrangements.
If the rooms are not rented to other guests, the hotel may apply a flat-rate deduction for the respective expenses saved, in accordance with sections 4.5, 4.6, 4.7, and 4.8. The customer is free to prove that the aforementioned claim did not arise or did not arise in the amount claimed.
4.6 If the customer cancels between 28 and 14 days (as per section 4.3.b) or 42 and 14 days (as per section 4.3.c) before the event date, the hotel is entitled to charge, in addition to the agreed rental price, 35% of the lost food revenue. For any later cancellation, the charge is 70% of the food revenue.
4.7 The food revenue is calculated using the following formula: Agreed menu price x number of participants. If no price has yet been agreed for the menu, the least expensive 3-course menu from the currently valid event offerings will be used as the basis for calculation.
4.8 If a conference package per participant has been agreed upon, the hotel is entitled to charge 60% of the conference package x the agreed number of participants for cancellations between 28 and 14 days (as per section 4.3.b) or 46 and 14 days before the event date. For any later cancellation, the charge is 85% of the conference package x the agreed number of participants. Up to 10% of the agreed room allocation can be cancelled free of charge up to 3 days before arrival.
